Section 74
Documents to be produced when taking bail, surety or bank guarantee
(1) When bail is taken from a person in accordance with this paragraph, if such person is not present at the time and place specified by the court, the condition that the bail will be forfeited shall be submitted in the format as per Schedule-29.
(2) When taking bail or bank guarantee according to this code, the amount of the bail shall be specified and the property shall be taken as bail.
(3) If the person who is required to give bail has given his assets as bail, if he is not present at the time and place specified by the court, he shall submit a document in the format as per Schedule-30 stating the condition that the bail amount will be recovered from the bailed property or any other property of his. Explanation: For the purpose of this paragraph, "guarantee" means bank guarantee as well.
(4) For a person who has to give bail in accordance with this paragraph, if someone else has given his property as bail, if he does not appear at the time and place specified by the court, schedule with such person on the condition that the amount of the bail be recovered from the bailed property or any other property of his with the consent of the person- The document should be submitted in the format as per 31.
(5) If the value of the property which has been given as surety in accordance with this section decreases due to any reason, the person giving such surety shall present the property equal to the value of such decrease before the court.
